In recent years, with industrial upgrading and the transformation of the pattern of international trade, the strategic emerging industry has become the focus the countries rushed to develop. However, behind the rapid development is the friction of intellectual property rights, it's particularly concerning that many developed countries are ready to use the intellectual property rights as weapons suppressing industry development in our country. In this paper the author introduces the strategic emerging industry in China the status quo of intellectual property in foreign trade friction, and efforts to change the status quo China made, then the improvements in the analysis of deficiency, finally puts forward some countermeasures for the improvement of China and developed countries.
